There are only mistakes in buying and selling, and there have always been many consumption problems. In the consumption of ceramic tiles, some people are deeply troubled by after-sales troubles, some encounter inferior counterfeiting, some are "killed" by relatives and friends, and some are "tricked into tears" by unscrupulous merchants... But have you ever seen someone who wanted to protect their rights but was sued by the merchant instead? Case?
Recently, The Paper client government account "Chenzhou Intermediate Court" disclosed such a case: A ceramic tile consumer was arrested by a merchant for making inappropriate remarks. We went to court and were eventually ordered to pay NT$25,000.
The following content is directly quoted or indirectly quoted from The Paper client government account "Chenzhou Intermediate Court".
Ms. L from Jiahe, Chenzhou, purchased a batch of ceramic tiles from Company B, the dealer of ceramic tile brand A, Jiahe, in April 2018 due to the need to renovate her house. Part of the payment has not been paid. .
In June 2021, Company B sued Ms. L to the Jiahe County People’s Court, requesting Ms. L to pay the principal and interest of the ceramic tiles, but the negotiation between the two parties failed. In the same month, Ms. L posted photos of cracking, damage and other problems with brand A’s tiles on her WeChat Moments for four consecutive days, with the caption, “The owner of the tile store didn’t care about the problem. There are many other tiles in his home that have this problem.” "I originally wanted to buy ceramic tiles, but now I'm just buying ceramic tiles." I also wrote messages like "Poor attitude and bad character" and "Don't let others be fooled" below, and posted in the neighbor group "Neighbors, please don't go to A in the future." "It's so deceptive to buy ceramic tiles from brand-name tile stores, I've been deceived by several of them" and so on.
After Company B’s attorney communicated with Ms. L, Company B first called the police and then filed a lawsuit with the Jiahe County People’s Court. However, neither the police advice nor the court mediation was successful. Have an effect. The court held that the photos and text posted by Ms. L in her circle of friends and neighbors about the cracking, damage and other problems of brand A ceramic tiles had no evidence to prove that quality problems were caused by brand A ceramic tiles. Ms. L has subjective malice to disparage and damage the reputation of A ceramic tile brand, affecting others' fair evaluation of A ceramic tile brand, infringing on the reputation right of A ceramic tile brand, and thus affecting A ceramic tile brand.sales, causing economic losses to Company B.
In the end, the court ruled that Ms. L should compensate Company B for economic losses of 15,000 yuan, pay Company B’s reasonable expenses to stop the infringement, evidence preservation and notarization fees of 2,000 yuan, and attorney fees of 8,000 yuan. yuan, a total of 25,000 yuan. In addition, Ms. L needs to publish information on her WeChat Moments to restore Company B’s reputation and apologize, issue a written apology letter, and post it in Company B’s stores.
Although Ms. L appealed, the second instance still upheld the original verdict.
As we all know, with the rapid development of my country's economy and society and the gradual improvement of people's living standards and consumption concepts, consumers have higher and higher requirements for products and services, and their awareness of rights protection is getting stronger and stronger. As a result, many ceramic tile manufacturers and dealers are paying more and more attention to consumers' demands. On the one hand, they strive to ensure product quality, and on the other hand, they continue to improve service levels.
However, since ceramic tiles have semi-finished properties of "what you see when you buy them, not what you get after decoration", and are very large in size and weight, it is difficult to determine whether they are products, especially if they appear to fall off, crack, or scratch after being laid. The problem of the product itself is still a problem of paving. The characteristics of low attention and low purchase rate make the general public know very little about it, which makes it difficult for consumers to protect their rights in ceramic tiles, and it costs time and money. All are big.
Because the cost of safeguarding rights is too high and they feel that safeguarding rights is not worth it, or they are angry at some merchants who shirk their responsibilities or are unwilling to face the problem directly, some ceramic tile consumers often overreact, but inadvertently infringe upon their rights. The rights and interests of ceramic tile manufacturers and merchants will end up losing more than they gain.
Zhongtaojun would like to kindly remind consumers:
When there are quality problems or other problems with the ceramic tiles you purchased, you should first calmly report it directly to the merchant or manufacturer and negotiate a solution. When a solution cannot be solved through negotiation, you should promptly file a complaint with the Consumers Association, Industry and Commerce and other departments, or apply for arbitration or file a lawsuit. Do not adopt irrational and inappropriate methods, especially with the mentality of venting. Making inappropriate comments - It is very easy to make complaints, but it is not easy to control the scale. If you are not careful, you will infringe on the reputation of the merchant by making excessive comments - so that you will fall into the embarrassing situation of "rights defender turning into infringer".
In addition, I feel that there is a common phenomenon among competitors in the building ceramics industry (to give a very intuitive example, every time the China Ceramics Network Douyin video reports which brand has won the award or achieved some achievements, comments The area will explode, either with a sour smell, or with a lot of scolding). Zhongtaojun would also like to kindly remind some pottery builders who like to make malicious comments or even slander and slander their competitors behind their backs:
Normal industry exchanges, discussions, and even complaints are okay, but you must speak slowly. Maybe when you are talking about others, others are also talking about you. What's more important is that he is a god when he raises his head and prevents recording behind his back when complaining.
