Watch the various aspects of the pottery industry quietly, and comment on the pottery people.
You have stories and I don’t drink. The truth is just as easy to get drunk on.
The 20th issue of [Spicy Review] is coming, please prepare the watermelon and small bench for the ceramic people.
”
I believe that anyone who has personally participated in the process of decorating their own house should have a deep understanding: Decoration may be the most troublesome thing in the world. It not only costs money and effort, but is also often accompanied by disputes and rights protection; as a decoration Ceramic tiles, one of the main materials, are often troublesome during decoration or during the purchase process before decoration, and they also bring disputes and rights protection.
It’s been a while since I’ve reviewed and commented on the disputes and rights protection cases involving ceramic tiles. Today I’ll have another round of reports from relevant media.
Case 1
Consumers are tricked by big brand ceramic tiles
A consumer complained about a certain big-name ceramic tile on Sina's "Black Cat Complaint" platform.
In July 2021, a major first-tier brand launched a promotion. One of the contents was that consumers could enjoy discounts by purchasing a card worth 200 yuan. The clerk of a Tianjin specialty store of this tile brand promised consumers that after purchasing the tiles, the card fee of 200 yuan can be refunded. Even if the tiles are not purchased, the money can be refunded. The consumer booked ceramic tiles with a total price of more than 3,000 yuan at that time, but was told by the clerk at checkout that he should pay a card fee of 200 yuan. The reason given by the clerk was that the card fee refund was not available for on-site bookings of less than 7,000 yuan.
This consumer believed that the clerk deliberately concealed the rules and deceived consumers, and asked the clerk and store manager to apologize and waive the 200 yuan card fee.
✎Spicy review
For consumers, before buying ceramic tiles and paying for the order, they must ask clearly and clearly. It is best to get the merchant's commitment in black and white and keep the evidence. Otherwise, "there are many promotion activities and they will trick you." Too much." For businesses, they should no longer be clever. Long-term development and brand reputation are more important than immediate interests. Those who treat consumers as fools are the real fools.
Case 2
House that has not been moved in after renovation
Cracks in tiles
In June 2018, a consumer in Xuzhou, Jiangsu Province renovated his home and purchased more than 20,000 yuan of ceramic tiles from a large-brand ceramic tile store in the local home building materials market.
After the house was renovated, the consumer and his family did not move in. More than two years later, in February 2021, he discovered that some of the tiles in his home had cracks. He reported to the media that the entire floor tiles were a bit "foggy". When he stood a little further away, he could see "flowers" on the floor tiles, almost on every tile. The after-sales staff of the merchant said that corrosive liquids might have been used during cleaning. "But who would use corrosive liquid to mop the floor?" He hopes that the merchant can refund all the problematic tiles, which involves an amount of approximately more than 18,000 yuan. However, the two parties communicated many times to no avail, and could not reach an agreement even when the home building materials market where the merchant was located intervened to mediate the situation. The merchant told reporters that ceramic tiles are fragile and easy to collide, and the principle of "delivery and acceptance" should be followed in the sale. More than two years have passed since the consumer purchased it and complained. During use, it contains strong alkali. , oxalic acid cleaning agents will affect the life of ceramic tiles.
The reason for the disagreement between the two parties is whether the problem with the ceramic tiles is caused by the quality of the ceramic tiles themselves or whether it is caused by external factors. To this end, the reporter consulted a lawyer. Lawyers said that whether there are quality problems with ceramic tiles requires testing by a third-party professional organization. According to the test results, if there are quality problems with the ceramic tiles, consumers can reasonably choose to request the other party to assume liability for breach of contract such as repair, replacement, return, price reduction, etc.
✎Spicy review
For consumers, it is really a dilemma to find a third-party appraisal agency to conduct quality testing on ceramic tiles in order to protect their rights. It is laborious and laborious to win, and it is even more painful to lose. For merchants, no matter whether they win or lose, they will not get any benefits. If they lose, they will lose money and their reputation will be ruined. If they win, they will lose their reputation and lose their compensation. Therefore, once a consumer dispute occurs, merchants must be cautious. The most important thing and the first thing to do is not to prove that they are not responsible, but to maintain brand reputation as a foothold and truly put customers as God and stand on their side. Think about things from their perspective. Sometimes, consumers may not care much about compensation, but just need a feeling of being valued and respected.
Case 3
The wall tiles in the finely decorated house fall off with just a tap
Recently, a developer of a finely decorated residential complex located in Wuhan, Hubei Province was complained by relevant owners.
The finely decorated rooms in this community have many problems such as water leakage, poor door frame materials, and potential safety hazards in the elevator. The quality of the tiles on the wall is even more worrying. They fall off and crack with just a light tap, just like they are made of paper; except In addition, its decoration standards are not consistent with those stipulated in the home purchase contract, including the doors, entrance cabinets and cabinets, which were all replaced by the developer without permission. The owner who complained said that it is really unacceptable that the finely decorated house that cost 200,000 yuan to renovate has become like this.
It is understood that so far, nearly 200 owners of the community have communicated and negotiated with the developer and the property management company, but the problem has not yet been resolved.
✎Spicy review
From a certain point of view, hard-decorated houses certainly save worry and effort. There is no need to worry about the color, specification and brand of ceramic tiles - the developer has thoughtfully chosen it for the owners. However, if you enjoy this undeserved peace of mind and effort, you have to bear the risk of undesirable tile designs and colors, substandard paving quality, and even substandard product quality.
Case 4
Repeated requests for labor fees to no avail
Decorator was jailed for smashing his own tiles in anger
In August 2020, Liu, the project leader of the Shiyan branch of a decoration company in Xiangyang, Hubei, hired Tan to lay ceramic tiles.
The two parties agreed in advance that Tan’s salary would be settled at 30 yuan/square meter. After that, Tan worked on three decoration sites undertaken by Liu. Liu paid Tan a salary of 5,000 yuan in advance, but the remaining 9,000 yuan was not paid in full. After repeatedly asking for wages without success, Tan smashed the tiles he had laid with a hammer in anger. After appraisal by the Shiyan City Price Appraisal Center, the price of Tan's damaged tiles was 12,376.89 yuan. Due to the large amount of damaged property, the decoration company that hired Tan took him to court.
The court convicted Tan of intentional destruction of property. Since Tan admitted his guilt and accepted punishment during the handling of the case, he was given a leniency and sentenced to 8 months in prison and compensated the plaintiff Liu for RMB 12,376.89 for the damage to his tiles.
✎Spicy review
This case tells us, "Renovation is risky, so please be cautious." Many people use their own personal experience in decoration to tell us that "don't hire acquaintances for decoration." This is another case where you need to be cautious when hiring people for decoration. Both cases illustrate that communication is very important in decoration construction including laying ceramic tiles, the spirit of contract is very important, and it is even more important to find reliable decoration workers.
